Europe
Luxembourg
A small country with a genuinely functioning national asylum procedure and, relative to its size, one of the higher per-capita application rates in the EU.
At a glance, for someone deciding whether to come here
Not tourist facts โ the things that actually shape daily life while your case is pending and after it's decided.
How you could qualify to enter this system
- In-land asylum application to the Directorate of Immigration
How the process generally works
Applicants register, are housed at a reception structure run by the Luxembourg Reception and Integration Agency (OLAI), and are interviewed as part of the review.
Step by step
Register
With the Directorate of Immigration; housed at an OLAI reception structure.
Admissibility check
The General Department of Immigration checks EU responsibility (Dublin III) rules.
Interview and decision About 6 months if admissible
A detailed interview, then a decision.
Appeal, if refused 1 month (regular procedure) or 15 days (accelerated procedure)
To the administrative tribunal.
What you'll typically need
- Passport or ID if available
- Evidence supporting the claim
Support available while your case is decided
- OLAI reception housing and support during the process
- Luxembourg Red Cross assists with reception services
Very small country, so options for where you're housed or resettled within it are limited by definition. A draft law would create a specialised "Asylum and Immigration Tribunal" within the Administrative Tribunal โ not yet in force as of our check, but worth asking about if you're navigating an appeal.
Common pitfalls
- Missing the much shorter 15-day appeal window that applies under the accelerated procedure, versus the standard 1 month.
- Assuming housing choice exists โ Luxembourg is small, and OLAI reception placement options are limited by the country's size, not a policy choice.
- Not checking whether the specialised Asylum and Immigration Tribunal (proposed, not yet confirmed in force) has changed which body hears your appeal.
